Private investigators can uncover a lot. That does not mean we can do whatever we want to get it. There’s a huge difference between finding information that’s publicly available and crossing a legal line to obtain something private. Public records? Public-facing information? Often accessible. Breaking into a house, logging into somebody’s private account, or pulling a Hollywood-style “investigator move”? Absolutely not. And here’s the part people forget: if evidence is obtained illegally, it can become a problem for the client, the investigator, and the case itself. A PI license is not a magic badge. I had a personal account for about five minutes, found a payphone in NYC, and decided the obvious thing to do was have my Daughter film me and everyone know I wasn’t too old for TikTok. 🤣 Deleted the app shortly after and moved on with my life. Finding digital evidence is getting easier. Proving it’s real is getting harder. With AI-generated deepfakes becoming more sophisticated, attorneys and investigators have to think beyond, “We found the video.” Where did it come from? Can it be preserved? Can it be corroborated? And can we establish that it’s authentic? Because “Your Honor, I saw it on TikTok” probably isn’t the evidentiary standard we’re aiming for. AI didn’t make investigators less important.
